An appeals court may uphold Judge Aileen Cannon's decision to dismiss the classified documents case against former President Donald Trump, an attorney said.Prosecutor Jack Smith is appealing Cannon's decision to the 11th Circuit Court of Appeals, which has twice overruled Cannon on decisions in the same case.
'She said that if the 11th Circuit agrees with Cannon, it should still allow the Justice Department to bring a new action against Trump 'via a constitutionally appointed special counsel.'Newsweek contacted Trump's attorney and Cannon's office for comment via email on Monday.In December 2022, the 11th Circuit sharply criticized Cannon while overturning one of her early decisions.
