Thomas’s warnings about special counsels as tools of what he calls a “monarchial” President are a bad fit with the immunity decision he signed on to, with its gift of Presidential impunity. It’s also at odds with Smith’s task. At the same time, the legal status of special counsels could be a lot clearer than it is. Thomas is not the only Justice who has expressed reservations about the special-counsel system.
