Texas Supreme Court sides with state in case to takeover of Houston schools

Mike Morath, Texas Commissioner of Education, speaks during the Dallas Regional Chamber’s 2022 State of Public Education at the Moody Performance Hall, Tuesday, Sept. 27, 2022 in Dallas. This is a developing story and will be updated.in a protracted legal battle over the attempted takeover of Houston ISD’s school board.

Friday’s order reverses a lower court decision that temporarily halted Education Commissioner Mike Morath from appointing a board of managers to replace the locally elected trustees.following years of unacceptable academic performances at a high school and other alleged failings by the trustees. By that point, the state had already installed a conservator to oversee operations.

“We expect the parties to reconsider their positions and supplement the record in light of changes in the law and factual developments within the District,” justices wrote. “We remand the case to the trial court for further proceedings consistent with this opinion.” Officials representing the Texas Education Agency said they are reviewing the decision. Houston ISD officials did not immediately respond to a request for comment.
