York’s First Assistant District Attorney Timothy Barker held that timeline to be exempt from disclosure under the Right-to-Know Law as a record related to a criminal investigation, and also bound by the terms of the state’s Criminal History Records Information Act, the same act Shapiro’s staff’s decision not to release the contents of its review last week.
Initially, Dye wrote, Marisa Vicosa was given the private criminal complaint form in error “as it was merely her intent, at that time, to lodge a complaint against the chief of the York Area Regional Police Department for failing to serve an emergency protection from abuse order in a timely fashion. In short, simply sought to have the court order properly served.”
It’s still likely not the final word on the Vicosa case, as the attorney representing Marisa Vicosa indicated last week that she does intend to pursue civil actions as a result of her daughters’ deaths.
