and will resume at 9:30 a.m. tomorrow. Judge Juan Merchan and the attorneys for both parties continued to speak at length after the jury was dismissed at 4:06 p.m.

In a tweet, South Dakota GOP Gov. Kristi Noem alleged that the jury instructions were, “a direct violation,” of pre-existing case law regarding jury instructions.that misrepresented the jury instructions. Merchan told the jurors that to reach a verdict, they don’t have to unanimously agree on what crime Trump was trying to cover up. They just have to agree he was trying to cover up a crime.

Cohen also testified that AMI previewed to him some of the stories that it planned to publish and that he said he would then show them to Trump.Steinglass had asked Pecker about a decision to renege on the agreement to sell McDougal’s life rights to the subject matter to Trump via a third party. American Media Inc., the National Enquirer’s parent company, had acquired the rights to the story."I called Michael Cohen, and I said to him that the agreement, the assignment deal, is off.

Trump said he doesn't buy those stories because they always get out, and he said he'd get back in touch, Pecker testified. Cohen called Pecker that day or the next day and told him he should buy the story, Pecker testified. In brief remarks to the media after court adjourned for the day, Trump said it was unfair that he was not out campaigning but instead spending time in court.

Trial days have typically adjourned by 5 p.m., though some days have gone longer, and yesterday's ran till 8 p.m.The judge asked jurors not to discuss the case with anyone else and specifically not to give information in return for any benefit. He also asked them not to visit sites or read accounts of the case in newspapers, television, etc.Katherine Doyle

Merchan wants the jurors to clarify whether they want the entire instructions again or just a particular part. He is going to bring all of them in, including the alternates. The jury's note suggests it’s focused on whether Trump joined the underlying conspiracy, which, according to prosecutors, was formed by Trump, Michael Cohen and David Pecker at the August 2015 Trump Tower meeting.

As we await the jurors, prosecutors and defense attorneys are paging through binders, seemingly on a search for the passages in question.David Pecker's testimony regarding the phone conversation with Trump while Pecker was in the investor meetingPecker's testimony regarding the Trump Tower meetingJudge Merchan said the court received a note from the jury at 2:56 p.m. There are four requests in the note.

Trump's message comes after Alito announced earlier today that he wouldn't be recusing himself from the Jan. 6-related cases before the Supreme Court.and conclude that he probably did exactly what prosecutors allege: Protect his 2016 campaign by paying off a porn star and then cover it up with phony payment records. But “probably” isn’t the bar for jurors. They are charged with evaluating whether there’s any reasonable doubt.

NBC News spotted Andrew Giuliani, son of the former New York City mayor, inside earlier. Fox News host Jeanine Pirro, Fox News legal analyst Jonathan Turley and Fox News host Trey Gowdy were earlier confabbing in the front row of overflow with lots of laughter and discussion. All three are covering the trial for the network so it felt like a live, in-person Fox News panel.Sen. Marco Rubio, R-Fla.

Jury deliberations technically began at 11:37 a.m. rather than 11:28, when they walked out of the courtroom because Merchan called jurors 4 and 6 back in to learn how to use the laptop containing evidence related to the trial. The jury has been instructed to refrain from deliberating unless they're all present.

The loudest of the group appears to be an older person holding a rainbow flag that reads,"Gays for Trump." They will hand in all cellphones and electronic devices and a sergeant will take them to another place to wait. The judge is bringing back jurors No. 4 and 6 to learn how to use the laptop containing evidence that the jury will be able to review.

It’s notable that the judge told the jury that the state wasn’t required to prove motive when so much of this entire trial has been the people trying to establish Trump’s motive. The “other crime,” Merchan said, is NY Election Law 17-152, which prohibits a conspiracy to promote or prevent the election of a person to public office by unlawful means.

Meanwhile, Lipps Inc.'s"Funkytown" blared on a loudspeaker as New York City's"Intergenerational Groove" event in Foley Square Park continues just down the block from the courthouse.Merchan is now explaining the elements of the felony falsification charge to the jury, clarifying that the business records at issue can pertain to a private business and that the records can be electronic or data.

What is necessary is that the jury is convinced that there is material, believable evidence independent of Cohen’s testimony to convince the jury that Trump is connected to the commission of the crime. He has mostly spent the morning so far leaned back in his chair, adjusting himself from time to time. The former president has also clasped and unclasped his hands in front of his chest as he sits.
