Tony Timpa’s family deserves its day in court | Opinion
Six years after the 32-year-old mentally ill trucking executive died while in police custody on the side of a road, it appears Vicki Timpa and other relatives will finally get their day in court.against the four Dallas police officers involved in the incident to go before a jury once and for all.
We urge the court to set a firm trial date for the case, so that the family and the public know what happened that terrible day in August 2016. A full airing of the disturbing facts is long overdue. The investigation showed that Timpa’s death occurred after he called 911 outside a store saying he was mentally ill, afraid and needed help. When Dallas police arrived, Timpa was already handcuffed by store security guards. Nonetheless police put him facedown on the ground and pinned him there for 14 minutes. Timpa yelled and begged for help more than 30 times until he lost consciousness.
But the city of Dallas, which is representing the officers, appears a long way from settlement. The city won an initial battle in the lawsuit in July 2020, weeks after Floyd’s death, when Judge Godbey agreed that the officers’ actions were protected under the doctrine of qualified immunity. But in December, the 5th U.S. Circuit Court of Appeals reversed Judge Godbey, challenging the officers’ claims that Timpa posed a threat even after he was restrained for more than 14 minutes.
