Attorneys marceelias of the DNC and dale_e_ho of the ACLU talk about the raging battle over voter suppression, the twin challenges of Trump and the coronavirus, and why, says Elias, “I think we’re winning more than we’re losing”
Joe Biden says, “This president is going to try to steal this election. It’s my greatest concern, my single greatest concern.” Now, I hadn’t heard it put so bluntly as that, and Marc, you’re on the front lines of this. You represent the DNC, and other Democratic organizations on voting rights, and mail-in voting, fighting voter suppression. Is that fear justified? Do you share Joe Biden’s fear about this coming election?Yeah, I do.
And does it automatically follow that if you use mail-in voting, that that automatically helps Democrats? I mean, that’s not exactly right, is it? He’s posited this as if it’s accepted by Republicans, but is it that clean of a truth, that the more people vote in by mail, the more it’s going to help Democrats. Is that true?No. There’s actually not much either empirical evidence or experiential evidence to suggest that.
So we’re likely to see more voters assigned per polling location in November than we’ve ever had in a presidential election, all at a time when we are being advised by public health officials not to congregate in large groups, and there’s this looming fear of a second wave of COVID-19 in the fall. So it’s a really, really big challenge.
And so, in the situation that we’re talking about today, where we are talking about needing to expand mail-in voting opportunities to replace those lost, or more difficult, in-person Election Day voting, I think we are talking about trying to protect the rights, and I don’t think Marc said anything that cuts against this or that he would disagree with this, but we are talking about trying to protect, particularly, the rights of younger voters, voters of color, lower-income voters, who would...
So I think it’s still the early innings, because a lot of these cases remain in the courts and various places, but what I say to folks is that, when the political branches fail to protect people’s fundamental rights, we need to count on the courts to do that. And that’s what I’m doing, it’s what Dale and many other lawyers are doing, and we have to hope that judges will take seriously their obligations, to make sure that everyone’s right to vote is protected.
And I think we need to be very, very careful, that as we watch this issue go forward, that we don’t see a prioritization of mail service in rural areas and a de-prioritization of mail service in urban areas.
The nightmare scenario, I think—and this is something that you were alluding to, and Marc was as well, about what keeps us up at night—is, imagine you go to bed on Tuesday night and one candidate is ahead in, say, those states or some others, but as the absentee ballots start coming in, the lead changes, right, and if it’s Trump, [the other candidate] goes from leading to falling behind. I mean, he’s laid the groundwork for what I think his game plan is going to be, right? Casting...
Right. Well, and this, again, back to 2000, that whole predictive system broke down around Florida, as we’ll recall, and there was a lot of soul-searching after that by the networks, about how it was they came up with these results, and supposedly there was supposed to be reform, and “we’ll never do it again.” So, maybe it’s worth remembering that again, and remembering what not to do, but they have their own motivations as we know.
