Texas leaders have forgotten their First Amendment constitutional duty, as HB 20...

Recently, Texas Attorney General Ken Paxton’s office won an appeal, which lifted the injunction, putting the HB 20 back into effect. At least until the next move, the Texas attorney general can regulate large social media companies for, in effect, not being conservative enough. All Texans and all Americans should be worried about this, both on the left and the right.

The CCIA argues that this is a basic First Amendment issue: “Ostensibly, conservative officials are doing very unconservative things with respect to businesses that take positions that they do not like.” All media companies engage in some curation. They do so, to a large extent, to avoid their platforms becoming cesspools of spam, pornography and disinformation. And having control over what and who they allow on their platforms is key to their function.

A major action that clearly inspired HB 20 was the removal of Trump from Twitter after the Jan. 6, 2021, insurrection at the U.S. Capitol building. This is obvious to true conservatives, but somehow not to the Texas leaders who voted for and signed HB 20, nor to the judge who lifted the injunction last week.
