For subscribers: The state Senate can keep some documents from the review of the 2020 election secret, but it must provide more information to justify doing so, the Arizona Supreme Court said Wednesday.

The Arizona Supreme Court said Wednesday that some of the Senate's documents from the review of the 2020 election can rightfully be shielded from public view, reversing a lower court order.

Communications can be shielded from public view if they involve official acts of the Legislature, not just crafting laws, the court said. Justice Clint Bolick recused himself from the matter because some of the communications on the privilege log were sent to his wife, Rep. Shawnna Bolick, R-Phoenix.TV host who promoted AZ 'audit' a key figure in search for documents at Trump residenceSenate President Karen Fann, R-Prescott, who oversaw the election review, praised the decision, saying the lower courts' rulings for her to turn over communications were made in the interest of"short-term political concerns.

But in a minor win for the parties suing to access the records, the Supreme Court said the Senate has not proved why withholding the remaining documents is justified under the law.
