Attorneys warned the state's Supreme Court justices Thursday about the life-or-death stakes surrounding a court order preventing the state from enforcing its near-total abortion ban.
Falk argued that the new abortion regulation, which was passed by a Republican-dominated General Assembly, marks a major government infringement into private lives. The lawsuit brought the state's near-total abortion ban to a standstill in September just a week after it took effect. Special Judge Kelsey B. Hanlon, a Republican, said the plaintiffs were likely to win because Indiana's Constitution is"more explicit" in protecting individual rights and shielding legislative interference into people's lives than the U.S. Constitution. She issued an injunction barring the state from enforcing it.
