The 22-year-old's lawyers previously said there had been a 'very significant miscarriage of justice' during a hearing at the Court of Session in Edinburgh.
A man who was found guilty of raping a 13-year-old girl has had his conviction overturned. Sean Hogg, from Hamilton, was ordered to perform 270 hours of unpaid work after a jury found he had sexually assaulted the teenager in 2018.
During a decision hearing on Wednesday morning, judge Lady Dorrian said there had been an "insufficiency of evidence" to convict Hogg. Solicitor General Ruth Charteris KC then confirmed prosecutors will not be seeking a retrial against Hogg as it was "not in the public interest". Hogg's legal team lodged an appeal against his sentence and conviction in Edinburgh last month. They alleged that a “very significant miscarriage of justice” had taken place.
