Elena Hernandez believes workers rights have slipped since the pandemic and unpaid trial shifts are becoming common practice for businesses looking for free help.
A Scots woman has been left feeling humiliated after doing an hour and a half of free work for a trial shift and then never heard from the employer again.
Speaking to Edinburgh Live Elena said: "I am 29 years old and have nine years of experience in hospitality. On the shift, I was doing so much. I was greeting guests, clearing tables and taking orders. "It was about an hour and 20 minutes, and I asked the manager if he wanted me to stay because it was so busy. The shift was only meant to be for an hour and unpaid. He said no, and that I could go."
"In another restaurant, they offered me two hours of an unpaid trial shift. Two hours! I won't work for free for two hours. In one hour you can see my skills and how I perform. But two hours isn't right. I told that restaurant that I wouldn't do it and I never got a reply from them either." Currently, unpaid trial shifts are legal in the UK as there is no legislation defining what trial shifts are or what they should be paid. The UK government sets out guidance for employers and within that adds that an unpaid trial shift may be 'reasonable.
