"Due to the anticipated request for depositions, defendants now face a choice between defending themselves in a civil action with the risk of incriminating themselves in the criminal case by waiving this vital privilege, or asserting their Fifth Amendment privilege in this case at the risk of impeding their defenses," Law wrote in his motion.
