It is claimed that the NHS board ‘failed to provide the level of care required by law’ by allowing him to keep operatingOne of the patients who were harmed by rogue brain surgeon Professor Sam Eljamel has lodged a criminal complaint against NHS Tayside, the board where he worked.
She claimed that he had removed a healthy lacrimal gland rather than her brain tumour when he operated on her, calling him “unqualified and unsupervised”.During this period, from 21 June to 10 December 2013, there was “no direct supervision” of Professor Eljamel’s clinical practice, including in operating theatres.
The surgeon, who left some of his patients with life-changing injuries, worked in Tayside from 1995 until he was suspended in late 2013. He has since moved to Libya where it is believed that he still practises. “The NHS Tayside board and their employees, including the surgeon and other medical staff, failed in their statutory duty ‘to ensure the health and safety so far as was reasonably practicable’ of myself and many others.”
