A mother is considering legal action after complaints over the care of her daughter, who died after choking on her own vomit, were upheld by watchdogs. The mother believes her daughter would still be alive if there hadn't been delays in getting her to the hospital. The privately run respite centre where the daughter was being cared for is now under investigation.

A mum whose daughter died after choking on her own vomit is considering legal action after complaints over her care at a respite centre were upheld by watchdogs. Tracy Steele believes Lauren Muir, who was being cared for at The Elms in Crosshouse, Ayrshire, would still be alive if there hadn’t been delays in getting her to hospital when she fell ill in December.

Lauren could still be alive today if staff had acted sooner, and she had received medical attention quicker. “I am considering seeking legal action because I want Lauren’s death to mean something – it needs to matter.” The provider must ensure all staff have the skills and knowledge to meet the needs of people they’re supporting and ensure protocols are in place for staff to follow when there is a change to a person’s presenting health condition.
