Police spotted Kyle Foggy five times in front of a woman's home in the hours before her death, courts records show. He later died after a highway rest stop encounter with police.

The state Attorney General’s Office did not say Foggy was charged with killing Cruz when announcing his death. And the Camden County Prosecutor’s Office on Friday announced murder charges against Foggy without saying he had died days earlier. Officers found Cruz’s cell phone on East Charleston Avenue, according to the affidavit. Investigators allegedly found multiple text messages and videos on the phone documenting the domestic violence incidents.
After arriving at the crime scene, the detective learned Lawnside police had encountered Foggy five times overnight Friday before they eventually found Cruz’s body.According to the affidavit, police first encountered Foggy at 8:30 p.m. Feb. 24 when a 911 caller reported a suspicious man across from Cruz’s home in the Lawnside Court Apartments.
At about 1:30 a.m. on Feb. 25, Tatem spotted Foggy running across Mouldy Road at the front of the apartments and jump into a vehicle on Hillard T. Moore Avenue nearby, the court document said.
