The collapse of the McFarland Apartments' wall onto Howard Henry's tire shop in 2016 launched years of litigation that was finally put to rest this month, weeks before a trial was to begin.

and several other legal challenges after the 25-foot wall next to the Mulberry Street Bridge in Allison Hill collapsed in 2016, dumping tons of debris, including a car, onto the back of his property, causing him to close his tire shop.

Henry said he plans to reopen his popular tire shop “in the near future,” although he doesn’t know exactly when and to what extent. The site had been a giant eyesore along a major route into the city until last summer when work began to rebuild the wall and cleanup the debris that had remain untouched for more than five years after the collapse.

One the McFarland’s two apartment buildings, the smaller one with 8-units, was condemned after the collapse out of safety concerns for additional collapses. Adam Klein, attorney for McFarland, said repairs on that building are nearly complete and his clients will seek to remove the condemnation order so the units can again be rented as homes.“The case at long last has been resolved,” he said.

Engineers from F.T. Kitlinski and Associates also were named in the lawsuit after they worked as engineers in a project to repair the sagging parking lot in 2008.but was again “settled and distressed” by 2007.
