Justices sent the case back to 4th District Court, where a hearing took place in November 2021. Lucia Tovar told a police officer she feared deportation and said that a Provo police officer told her, “As long as you’re working with us, it’s not going to happen.”
When asked why he lied, Epifanio Tovar said he was “threatened” by police and lied “because that’s what they [police] wanted me to say.”
