The Government is considering amending the Criminal Justice Bill amid a Tory rebellion despite insisting it will not see rough sleepers fined for bad body odour.
The Criminal Justice Bill will repeal the Vagrancy Act 1824, the law which currently criminalises rough sleeping and begging The Home Office is considering amending the Criminal Justice Bill, which would allow the police to fine “nuisance” rough sleepers, to clarify that people could not face sanction simply for having bad body odour.
The Government has maintained the law does not criminalise people for having bad body odour, and is instead intended to target those dropping rubbish and having an impact on the environment and public health and safety.Guidance will also be drawn up for the police which makes clear people should not be arrested for having bad body odour.
Amendments tabled by Mr Blackman would seek to ensure ministers fulfil their promise to repeal the Vagrancy Act 1824, the law which currently criminalises rough sleeping and begging.
