OAKLAND — The murder trial for an Oakland man started Tuesday morning with dueling accounts of a 2019 fatal shooting at a local homeless camp, as well as a protest from the defendant that his jury doesn’t, “come from the same background I came from.”
“It turns out these were not real guns, but they darn well looked like guns,” Bryden said, later adding, “You wouldn’t know they were pellet guns without some type of examination.” Colston was one of five people arrested and charged in 2019, yet he’s the only one to go to trial. Joshua Lucas — who stabbed Busby in the leg — pleaded no contest to voluntary manslaughter for a 12-year prison term last year, and Derrick Simmons pleaded no contest to accessory in 2020.
He added that Harper, not Colston, had an issue with Busby for allegedly disrespecting Harper’s girlfriend. He said the group was in the area to “buy recreational drugs” when they basically stumbled upon Busby and confronted him.admitting to paying a witness
