Heron Gonzalez Jr. faces a capital murder charge in his baby daughter's death in Fort Worth.
Gonzalez was taking care of Aracely and his 2-year-old stepson while their mother was at work. He told police he put the baby down to nap for about 40 minutes before he checked on her and found her unconscious, the affidavit says.
The mother told police she would typically “keep tabs” on Gonzalez because she “was worried that he would get too frustrated or anxious caring” for the kids, police wrote in the affidavit, but said he had never been violent with them.According to the affidavit, an autopsy showed Aracely suffered injuries including bruising on her chest, a liver laceration, multiple rib fractures, acute cerebral hemorrhage and retinal hemorrhages. Her death was ruled a homicide.
A search warrant was issued for electronic devices, including both parents’ phones, last August but the affidavit does not show any developments in the case until it was reassigned for further investigation in July.Around that same time, Gonzalez was indicted on a continuous family violence charge in a separate February incident, court records show.
An officer wrote in the affidavit that he reviewed Gonzalez’s phone history and found he had made searches on how to do CPR on a baby starting about 3:25 p.m., then called the baby’s mother and one other number before ultimately calling 911 about 3:40 p.m. Although Fort Worth police had not been able to speak to Gonzalez since last year, the affidavit says detectives believe “given the totality of circumstances” and timeline of events that Gonzalez is responsible for Aracely’s death.
