FREMONT — More than a month after a federal jury decided Fremont owes nearly $10.3 million to the family of a 16-year-old pregnant girl fatally shot by some of its police officers, the city is asking a judge to override the verdict, lower the amount of damages or agree to a new trial.
“It sounds as if they’re going to maintain that position even in the face of a jury verdict and public outcry,” Pointer said. After a nearly weeklong civil trial in a San Jose federal court in June — during which the jury heard emotional testimony from Mondragon’s mother, saw photos of Mondragon’s wounded body from a medical examination and saw at times heated exchanges between attorneys and witnesses — the juryThe jury said that three Fremont officers — Sgt.
“Based on a search of the jury verdicts and settlements of wrongful death actions involving the death of a child, the jury’s award in this case would be the largest award rendered in this district,” the attorneys’ motion said. The attorneys noted during the trial and in their filings that Elena “had trouble in school, and often left the house without permission.”“They want the court to give them a discount because this 16-year-old girl wasn’t a straight-A honor student. As if a person’s love for their child equates to their GPA,” he said Friday.Pointer said the motions the city has filed are “super longshots” and he thinks they will fail.
