President Biden issued a new executive order that would limit asylum claims at the southern border.
Chinese migrants wait to be processed after crossing the border with Mexico Wednesday, May 8, 2024, near Jacumba Hot Springs, Calif. by Customs and Border Protection, there were 179,725 encounters at the southern border in April. This is down from 189,357 in March. These numbers, however, are a big decrease from December when there were nearly 302,000 encounters.“ Gotaways ” are migrants that have evaded Border Patrol but were detected by other forms of surveillance, like cameras.
Biden’s new executive order gives him the authority to shut down asylum requests at the southern border once the number of daily encounters reaches 2,500 between ports of entry. This means border officials will be able to turn away migrants without giving them a chance at asylum., which gives the president the authority to restrict or suspend the entry of specific groups of migrants if their entry would be “detrimental” to the interests of the U.S.
President Trump invoked this several times during his presidency, including for his controversial Muslim ban. Biden’s executive order is modeled on the bipartisan border bill that failed in the Senate. Indeed, the idea of limiting asylum requests once encounters reach a certain number was in the border deal, though the threshold was 5,000 per day.
