The Tribunal's decision relates to the incident that took place in 2017
A Wellingborough doctor who sexually harassed a colleague has had their three-month suspension lifted. Dr David Darby made unwanted comments related to sex to the colleague and the Medical Practitioners Tribunal Service panel has now determined that Dr Darby’s fitness to practise is “not impaired” by reason of misconduct.
While working for Northamptonshire Healthcare NHS Foundation Trust, Dr Darby asked the female colleague if she was menopausal, if she ovulated and about her vaginal secretions in or around June 2017. He was also found to have told her: “If you lose a stone, I will give you a massage." A tribunal in June of this year upheld the complaint made to the General Medical Council that Dr Darby’s behaviour towards his colleague amounted to serious misconduct and that his fitness to practice was impaired. A second tribunal on October 2 set out to determine whether his fitness to practise is still impaired, taking into account whether the matters can be remedied and if they have any likelihood of happening again.
The panel noted Dr Darby was of previous good character and the misconduct occurred within “a context of personal and workplace stress”. In a reflective statement, Dr Darby said: “My behaviour has been deplorable and unacceptable. Having said this, and now that I can see what was happening, I see the whole issue in a different perspective.
