A North Carolina fencing club owner accused the university and the others of trying to cover up a sexual misconduct incident.
WILLIAMSPORT -- A North Carolina fencing club owner and coach has appealed the dismissal of the federal suit in which she accused Penn State and two coaches of trying to cover up a sexual misconduct incident and defamation.
Reasons the judge gave for dismissing it included: Oldham did not have any direct connection with the university or its fencing program; and she failed to raise certain allegations in a timely fashion.for how it dealt with the sexual misconduct complaint given its experience with the Jerry Sandusky case. He wrote:
The basis of Oldham’s suit was a Dec. 12, 2017, incident when she was seated next to Abashidze on a flight from Portland, Ore., to Chicago. The results of an investigation by Penn State determined the allegations of assault and harassment were true but that Abashidze had not violated any university policy.
