A pair of bills that bring religion and pryaer to schools may threaten, rather than enhance, religious liberty.
Senate Bill 1515 would require public schools to post “at least” a 20-by-16-inch durable copy of the Ten Commandments “in a conspicuous place in each classroom.” The bill has many problems and may not pass constitutional muster.Two bills related to issues of religious liberty are under consideration by the Texas Legislature and should be on the radar of anyone interested in religious liberty and public education.
The bill’s religious partiality is its first problem. The bill declares the displayed Ten Commandments should be the version recognized by Protestants, which differs from the Ten Commandments accepted by Roman Catholics and Jews, in ordering and language. The differences are even more stark to those who practice other faiths and to nonbelievers.
Only a student whose “parent” has consented in writing may participate. If the parents disagree, the bill is silent regarding what happens. The bill asserts that by “consenting,” the “person” waives all legal rights related to such a policy. The bill indicates that no student who does not consent will be “within the hearing of” those reading a religious text, and no prayer or reading shall be made “over a public address system.” Thus, consenting students will be in a space where only they can hear prayers. But if the student participants disagree about what to read aloud, what happens? The bill does not address this either.
