Council rejected the request in a 9-to-7 vote two weeks ago, but minds have since changed.

The one-year contract with NashWest LLC – for up to $234,000 - will provide Turner with a part-time NashWest employee to oversee the clerk’s office’s portion of the implementation of the court’s new case management software, Odyssey.

Council’s change-in-course came after Council President Blaine Griffin appealed to members to reconsider the contract. Griffin resurrected Turner’s request because council attorneys had warned him that Ohio law limits a legislature’s ability to deny expenses that are considered necessary for court operations. That law, according to a council spokeswoman, could’ve allowed Turner to sue council for denying his request.

“The real issue is how much latitude do they have to reject the contract,” he said. “I think they don’t have much room.” Councilman Kerry McCormack, for instance, wanted a breakdown of how the $234,000 would be spent. Turner provided it on Monday. “It makes a difference when you’re transitioning from one system to another, having a person that knows both,” Bates said.
