Prosecutors say the clerk, James Williams, 36, should not have chased two robbery suspects out of the gas station and start shooting at them.
Contra Costa District Attorney Diana Becton released a statement Thursday saying her office would not charge the robbery suspect, Ronald Jackson Jr., 20, with murder because the slaying could be considered self-defense under California law.
The statement says Williams continued shooting at Jackson and that’s when Jackson returned fire, hitting Williams in the chest and leg. “In the eyes of the law, Mr. Williams’ actions ceased to be self-defense when Mr. Williams pursued Mr. Jackson and the other suspect with a firearm — and continued to pursue Mr. Jackson after he shot him,” the statement says.
