Alvarez prevailed in part one of a two-part race to fill the seat now, but his opponent Georgette Gómez leads the primary race for the next term

Democrat David Alvarez will be sworn into the California Assembly Wednesday, after an apparent victory in a special election for the 80th Assembly District, but weeks before the vote is officially certified.

Assembly Speaker Anthony Rendon has tentatively scheduled the swearing-in ceremony for Wednesday at the state Capitol in Sacramento, said Katie Talbot, communications director for his office. Although the election won’t be certified for several weeks, Talbot said the speaker has the authority to make that call based on early returns, according to a section of the California Constitution that states “Each house of the Legislature shall judge the qualifications and elections of its Members.

Because of that, Alvarez will take the open seat this month, but will face Gómez again in the fall general election for the next term. He said he’s focused on taking office and isn’t worried about the next round. An unflagging door-to-door campaigner, Alvarez said his campaign made contacts with more than 40,000 voters and he personally communicated with several thousand in person, or by phone or text.

“He’s still got to navigate the minefield of a thousand votes on complex legislation between then and now, each one providing fodder for an attack ad or voter anger, between now and the election,” Kousser said. “The incumbent advantage is earned by politicians serving constituents, not just conferred by a ballot title.”

“What’s their stance about what they’re going to do about the homeless problem?” asked Fritz Ahern Jr., who owns a commercial property in the neighborhood with his father. “We’re obviously worried. We see it every day.”
