Alabama, for years, has delayed turning over records that may shed light on how often public schools place children in seclusion or under physical restraint. From the aledlab:
Until this week, there was no standard format for reporting when schools used restraint and seclusion, and it appears the department does not compile reports into a single document. Multiple officials told AL.com that some reports are handwritten and on paper. It is not clear if reports are reviewed or analyzed.Then, in October 2022, two months after saying the records would be scanned and released, the department’s communications changed.
The department’s general counsel, Jason Swann, took over the issue. Since then, in response to repeated requests, Swann told journalists that the department is working on AL.com’s request, reviewing records to make sure no students’ names are included.This week, the state department sent its annual request to school districts to report incidents of seclusion and restraint. It asks officials simply to record the number of incidents at each school on an online form.
Reports about incidents involving seclusion and restraint help parents, educators and advocates figure out what happened and why, Anderson said. And reports also should indicate whether certain teachers, classrooms, grade levels and groups of students are using restraint more than others. “In our caseloads, the mass majority of schools stopped reporting or accurately reporting years ago,” Gallini said. “I’m discovering that they stopped doing de-escalation and restraint training, have few personnel certified, rarely fill out restraint documentation, and I’ve yet to see a document informing parents that their child was put in one of these [seclusion] rooms. They may verbally be informed but not in writing.
