ACLU sues Fulton County over missing records from 2020 election review

In the new lawsuit, the ACLU recognizes that the county released 691 documents but says there are materials missing from the collection.Specifically, the ACLU was looking for contracts and email communications with Wake TSI that are discussed and referenced in other records, including a contractual document signed by Wake TSI co-founder Gene Kern and Fulton County Director of Elections Patti Hess that was referenced in an email released by the county.
The records relating to a non-criminal investigation are exempt because they include “investigative materials and records that, if disclosed, would reveal the institution or progress of an agency investigation” There are also documents not turned over that “must exist given the nature of an election review,” the ACLU said in the lawsuit. This would include any records related to the cost of the review, payment records, drafts of the review report and evidence of how Wake TSI maintained the security of any election information.
