Abbott should drop this pandemic restriction | Opinion
Gov. Greg Abbott holds up a disaster declaration for 23 counties impacted by severe flooding at a press conference on Aug. 23, 2022, at Dallas City Hall. One of the governor's emergency declarations for the COVID pandemic is still in place, and limiting due process, writes the editorial board.Just as it’s time for the federal government to lift its overarching COVID-19 authority, Gov. Greg Abbott needs to lift all pandemic restrictions too.
The public health emergency order was intended to ensure “that alleged violent criminals are not released en masse” in response to news that incarcerated people were being released when the system couldn’t process their cases in a timely manner. One such case was Donnie Reed Davis, who was arrested Feb. 2, 2020, for possession of marijuana and aggravated assault with a deadly weapon. He couldn’t afford bail, but the pandemic meant that his case didn’t move forward. By law, Davis was entitled to release from jail if his case had not progressed in 90 days. District Judge Deborah Oaks Evans in Anderson County found that Davis met the criteria to be released, but she declined to let him go because of GA-13.
