The Sosa Act allows for a defense to prosecution of a person who is first to call 911 about a possible overdose, so long as the person made the request during an emergency, stayed on the scene and cooperated with first responders. The Sosa Act’s restrictions were likely a compromise between two competing goals, preventing fatal overdoses and prosecuting serious drug offenders, said Zachary D. Kaufman, a professor at the University of Houston Law Center and Boston University School of Law. The bill was approved with bipartisan support. Rep. John Raney, R-College Station, who authored the bill, did not respond to our requests for comment.
