A judge in Fulton County, Georgia, on Thursday denied Sidney Powell's effort to dismiss her charges in the sweeping racketeering indictment ahead of her trial later this month.
Fulton County Superior Court Judge Scott McAfee denied Powell's motion to dismiss the indictment based on her lawyer's claims of prosecutorial misconduct. His rejection came during a hearing over a variety of pretrial motions ahead of Oct. 20 jury selection in her joint trial with Kenneth Chesebro.The pair of attorneys were indicted in August along with former President Donald Trump and 16 others as part of a sweeping racketeering indictment recommended by a special grand jury.
"I don't see that as clearing just a procedural bar of being something that's under the Court's authority," McAfee said when denying Powell's motion from the bench.Both Chesebro and Powell requested a speedy trial in the case and are being tried separately from the other defendants. They are slated for a jury trial on Oct. 23.
