A magistrate for the Franklin County Court of Common Pleas has denied the injunction that previously paused proposed changes to the State Board of Education.
FILE -- Ohio Gov. Mike DeWine speaks during a news conference, Feb. 21, 2023, in East Palestine, Ohio. At least part of a Republican-backed overhaul of the Ohio K-12 education system will take effect as planned, despite a court order Monday, Oct. 2, delaying the changes after a lawsuit said they violate the constitution. DeWine says that the Ohio Department of Education and Workforce will replace the Ohio Department of Education midnight Tuesday, Oct.
This means that the magistrate essentially ruled against opponents of the state's overhaul of the Education Department on Friday, but the saga was not finished.A judge needed to approve of the magistrate's decision before the case was settled. However, a judge ruled in favor of the state not too long after the magistrate denied the injunction.
Now the state is able to move forward with their changes to the Ohio Board of Education as originally planned. Gov. Mike Dewine's proposed changes will shift K-12 education oversight from the Ohio State Board of Education to an official appointed by the governor — drastically changing who makes decisions about academic standards, curriculum and district ratings.
