A trial underway in federal court will decide whether the U.S. government must pay up to $21 million to compensate a Virginia county for land taken to expand Arlington National Cemetery

A trial underway in federal court will decide whether the U.S. government must pay up to $21 million to compensate a Virginia county for a parcel of land taken to expand Arlington National Cemetery. The cemetery expansion project has already begun work and is expected to extend the cemetery’s life by nearly 20 years, until 2060.
The federal government says it's fulfilling its duties by replacing and improving the road network on the cemetery's southern border, including significant improvements to a highway, Columbia Pike, that serves as a primary commuter route. The federal government says improvements to the roadway adequately compensate the county. The improvements to Columbia Pike make it significantly wider and straighter, adding sidewalks and bike paths. The bike paths, as an example, widen the road's footprint and necessarily take away space that could have been used for burials, former cemetery superintendent Katharine Kelley testified Monday.
"The county is looking for a windfall from the federal government using the very road the federal government conveyed to the county for free," Justice Department attorney Emma Hollowell said during opening statements.
